It seems that the nonprofit American Oversight has requested "records related to communications on net neutrality between Internet service providers and Chairman Ajit Pai or Pai's staff."
The FOIA requests have a 20-day limit, which was passed without the FCC providing the requested information.
Instead of providing the information, the FCC basically dragged its feet...hence, the lawsuit.
For the most part, people see this as basically Pai giving the middle finger to the Freedom Of Information Act.

And for a bit of history, you can thank President Lyndon B. johnson for signing this Act into law on July 4, 1966, a fitting date.
