He definitely carries most of the responsibility. Given he was the driver and probably distracted by the seatbelt. With that being said I am honestly surprised that a rail road crossing on such a complex street would only have a couple of flashing lights.

I think the miss was intentional. When I was doing martial arts, there was an older guy in the class who got accosted by some teens one night. He just showed them that he could possibly kick them in the head, and they all backed off

#8 Wild, whole pile of stuff in that. The driver is gonna be dinged for putting his seatbelt on while rolling, but I think he was done with that a few seconds before he needed to look up and see that the crossing lights were NOT flashing or if they were, so dim they didn't show on video. Then some numbskull put a (temporary?) stop sign too close to the crossing. Also the train seemed to be going double the speed that is usual in built up area without barriers on crossings.

They were flashing. He then looks left, then right, then only left (4 more times) while the train is approaching on his right. He didn't want to stop, so he tried the "ol' well it's not here yet so I can still get through"...except it was on his right...

Got it fullscreened and still cannot see the flash, from way back there's an artifact where the white windows in the building behind pass behind the lights but no flash.

The angle is bad on the exterior camera but in a couple moments looking closely you can tell that the lights were flashing, on the side and overhead. Going through with flashing lights is really the end of the story, but his second level of stupidity was only looking right once, before he could really see very far down the track, and then never looking right again while repeatedly looking left.

Thanks, much better vid, flash obvious, the one posted starts a couple of seconds after the good headon view of lights and is cutoff on the left side too. Even knowing the flash is there I still can't see it on this one, some frames where it looks a little redder but that could just as well be light angle changing on the lens of the light.

There's a reason warehouse shelving should be bolted to the floor, to the next rack over and to the wall. Also there should be a partition between where the work area is and the first shelves. Completely preventable accident.

Hopefully the authorities saw this video and stripped him of his CDL. So many stupid things he did in that video. He is clearly a danger to those around him on the road, so he shouldn't be able to drive heavy equipment again.

Right of way means if two vehicles enter an intersection, the one without the right of way has to yield. In case of a possible collision, you still need to attempt to avoid it, but if you faild to yield, the collision is legally your fault. The reason trains always have the right of way is because they are physically incapable of stopping in time. Trains have their own signals but it's not like driving a car.
