It probably doesn't protect citizens from breathing polluted air (like second hand cigarette smoke and car exhaust). Remember that the Constitution was written water pollution wasn't much of an issue.

its worth noting on the AI CSAM ruling that is only applicable to the possession, as there isn't a victim. The other charges all go through as they should, but the wording of requiring there to be a victim is what keeps that 2002 supreme court ruling from allowing that to go through. The judge expressed concern and urged the supreme court to update their 2002 ruling to accomodate such cases.

Due process starts with informed consent. It’s not about the water, it was about due process. Had people been told, they could have taken other actions to prevent their babies and children from becoming intellectually disabled through lead poisoning. Trust me, that’s gonna cost a lot more in the long run than swapping out those pipes.

The 9th amendment is pretty clear that it's an illegal ruling. Also the 14th, as hiding poison in the water is depriving people of life.
