Depends where in the world you are. Here in Sweden the maritime laws state that you have to respond to all and any calls for help at sea. Which this falls under as they where hailed multiple time and there was an stranded boat.

All correct, but the vessel in need does need to broadcast a pan pan of mayday to indicate their need for help. And depending on conditions and type of vessel being out of fuel is not necessarily an emergency. If the calling vessel did declare an emergency they should have received help, but we don't know if they were denied help or maybe the yacht just did not follow the mandate to listen to emergency channels.

I remember when I was in the navy rendering assistance to a very flash super yacht who radioed an emergency... We arrived and they had run out of potatoes. Those guys live in a different world...
