Im not saying insanity isnt a plausible argument but 3 children were strangled to death. And there needs to be repercussions for that. We cant just..... ooopsie 3 lives and walk away.

In an insanity defense the repercussions are typically institutionalization for a very very long time.

If the jury had reached a verdict she would have been locked up no matter what they came back with.

This is literally the only scenario where she might walk away but she still hasn't walked away because mistrial means she can be tried again.

No one, not even her, is disputing that. With an insanity defense the only dispute is if a prison or an institution is the most fitting place to lock her up.

My main takeaway from this has been that all of this woman's online critics seem to skip right over the question of whether her condition should be a valid legal defense. Instead, they go straight to denying that her condition is real and just generally being misogynistic.

Maybe (probably) I'm looking in the wrong place, but I haven't seen anyone saying "as horrible as her experience is, it shouldn't absolve her." Just "haha, women love killing children, mental health isn't real."

Maybe you don't hear that cause it isn't an absolution.

Insanity defense are not get out jail free cards and in some situation the person end up institutionalized far longer than any jail sentence because there is no term to it.

You get commited to a hospitals card until a medical professional deems you safe to be in the community.

As horrible as her condition is, it shouldn't absolve her. She had major depressive disorder, not post partum depression or post partum psychosis. She didn't want to try different meds for anxiety. She didn't check herself into in patient treatment on a few occasions where it was offered. Why'd they go with the post partum psychosis defense? Andrea Yates. Yates was found not guilty by reason of insanity during the retrial and is institutionalized to this day.

That’s the deal you make with insanity pleas- you get out of the jail, but you do mental health treatment per the court order until the court is satisfied. Which is fair- if you’re insane enough to do it once, you need to be treated to protect others. Often the insanity plea will be a linger term, cuz what doctor is gonna certify you as not a threat anymore?

Welp. Yates' is also severely mentally ill. In no uncertain terms was she competent. The husband and mother were told to never leave her alone with the children. They did, and the kids died. It's horrific and sad, but if anyone deserves absolution, it's her.

It's worth noting an insanity defense isn't absolution. It's in many way no different than pleading guilty and can lead to longer incarceration than a guilty plea in cases of severe mental illness.

Here's the thing: she was never going to walk away free from any of this. If they had found her competent and convicted her she would have gone to prison. If they had found her not guilty by reason of insanity she would have been locked up in a mental institution for the criminally insane. Either way she would be locked away and do serious time for her crime, not given a slap on the wrist and let go.

NOBODY is handing out free passes to murder people just because you're temporarily insane.
