They said the agency could not decide to forgive the loans using the emergency power given by Congress, without Congress ordering it.

This mean an agency cannot do what Congress said it can do without Congress approval, if it is not narrowly and specifically worded as something they can do, to a "Tea" *lol*.

This means, and hold my beer here:

Immigration cannot decide if to detain aliens at the border, since the immigration act (ina) does not specify that as a task. It only allows the agency to detain aliens illegally present, not illegally crossing.

So they gotta allow them in, wait till they count as illegally present, then detain them. (If they say they seek admission they are not illegally present, so they can't detain them even if inside US).

It cuts both ways too.

It means the CDC can regulate who gets an abortion, over State bans, without Congress, because Congress already gave that power in the 80s after aids, without specifying aids but "transmissible diseases".

So if the pregnant woman has a transmissible disease, the CDC can recommend an abortion over any State rule or law, to prevent further transmission of the disease.

Remember the Sup.Cunts said Congress must specifically allow it in a tailored grant of that power that is specific. But not too specific that it causes Congress to think itself an expert in the topic.

So as long as it is understood is allowed, for example loan forgiveness, using similar or equal wording, it is allowed. But unspecific open ended like "can forgive during emergencies" is too broad.

So it is too broad to say "a disease" or "for mental reasons" but it is not too broad to say "transmissible disease" if it puts the kids at risk of being sick.

So using the same wording we could justify killing diabetics too, or sterilizing them since they will transmit the "disease".

So in reality, and as usual, when "Cuntservatives" want and do, they shoot themselves in the foot every ducking time.

And the way they play with words to fit their narrative will open the door for so much more. Because they don't see consequence of their words, just pushing ideas that benefit some.

Also: cases with false facts that haven't occurred aren't new, even those with fake scenarios are decided. However, keep in mind forcing an employee to work on a religious holiday the employee chooses to celebrate is now discrimination. So go grab your Jewish holiday calendar, and catholic calendar, and celebrate. You will have your own "saint" day off, for first and for middle name, two extra holidays there, for example.

The problem with conservatives is gag reflex lack of foresight. Vote them mofos out.

I appreciate your efforts, but there's multiple issues with the theories you came up with. Border Patrol does only detain people present, they don't cross into Mexico. Where border patrol actively is, is on the US side. 1 foot in, is present. CDC recommending an abortion doesn't matter, because the state laws typically penalize the doctors. So the doctor may get the CDC recommendation, but that doesn't override the state penalty, so the doctor will choose not to do it.

The Supreme Court is acting on a political agenda rather than legal precedent and principle.

Does anyone really think they will allow this decision to be used in ways they don’t like?

This, the ruling on affirmative action and the ruling on that BS web designer are retaliation by the Republican SCOTUS against Trump's indictment, nothing more. It's a joke.

Nope - it's what they've been bribed to do, nothing more...

Here’s the problem with your logic, the GOP doesn’t care about “cuts both ways.” They made this decision to hurt people and they won’t hesitate to move against this decision in another circumstance if it means hurting more people. There is no intention to play fair or follow their own rules

Stares in ASME code.... So they have to ratify every order given by or improved by an organ of the state that has already been given the powers to make rules in specific fields. This takes, the IRS, SEC, OSHA, ASME, ASNI, any regulation industry out at the fucking knees. Didn't y'all learn that regulation is important after that sub killed rich people? Fucking hell that is just dead ass bat shit crazy. Congress now needs to approve the kind of welds that can be used on boiler plates I guess.

I mean it's not only the student loans (which is a big fucking deal!) About also holy fuck so I can no longer be arrested for saying I'm a doctor and cutting bits people open because the agency in charge of medical certification process doesn't have direct authority to give me approval or denounced that I have not been given approval. Health agencies cannot say I must close my restaurant due to mold because Congress has not given them direct authority to close my restaurant.

Ah yes and there go my workers rights, because the people saying a job does not have to abide the organization to monitor worker safety as they made no direct law saying I must shut down machinery while it is being worked on. This is sooooo fucking wide reaching and just deregulated every single industry, safety organization, watchdog authority, hell it deregulated the SCOTUS because Congress did not give them the authority to make such a decision.
