There are several requirements to make a menorah kosher. Here are the two most basic ones:
1) The eight candles of the menorah must be in a straight line.
2) The menorah’s lights should be level (none should be randomly higher than others).
It just irks me so much when I see people using them.

I was unaware, until today, that 31 feet was the maximum height for a menorah to be considered kosher.

Actually the rule is "level or on an even slant". So these examples are actually both fine. They are evenly slanted, not random.

So on your first not kosher example, would in be acceptable if the candles were different lengths so the wick/fire is at the same level?

The actual rule is "an even slant" so op's examples are actually just fine.
