It's a tricky thing with implied consent. Even if one would have a fairly reasonable expectation of a consent, what would happen if it turns out the consent wasn't actually given?

However, I come to understand that non-binary denote fluidity while binary denotes rigidity of identity. A binary trans man, for an example, would be all in on male identity eshewing any femininity, while a non-binary would exercise greater flexibility of incorporating them into an otherwise masculine identity.
